Terms of Use

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the Vybe mobile application (the "Service", "App") operated by Vybe ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. The Service and AI Disclaimer

Vybe provides a digital wardrobe management tool and an Artificial Intelligence (AI) styling assistant. You acknowledge and agree to the following regarding the nature of the Service:

• AI Fallibility: The App utilizes advanced generative AI models (including Google Vertex AI and Gemini) to analyze images, identify clothing, and generate style recommendations. AI is an evolving technology; it may misidentify colors, patterns, or items, and may generate advice that is subjective or inaccurate.
• Entertainment & Assistance: The AI Chat Stylist and Daily Vybe recommendations are provided for entertainment, organizational, and general lifestyle assistance purposes only.
• No Liability for Outcomes: We are not responsible for any personal, professional, or social outcomes resulting from your reliance on the App's wardrobe or styling advice.

2. Accounts and Registration

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password or authentication credentials (e.g., Google Sign-In) that you use to access the Service and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. User Content and Acceptable Use

A. Ownership

You retain all ownership rights to the images, text, and other content you upload to the App ("User Content"). By uploading User Content, you grant Vybe a worldwide, non-exclusive, royalty-free license to host, store, process, and display your content strictly for the purpose of operating and providing the Service to you.

B. Acceptable Use Policy

You agree NOT to use the Service to:

• Upload, process, or transmit images containing sexually explicit material, non-consensual intimate imagery, or severe violence.
• Upload content that infringes on the intellectual property rights of others.
• Attempt to reverse engineer, decompile, or otherwise extract the source code or underlying AI prompts of the App.
• Use automated scripts, bots, or scrapers to access the Service or exhaust our API endpoints.
• Intentionally trigger rate limits or execute Denial of Service (DoS) attacks against our Cloud Functions.
• Abuse developer codes, promotional systems, or subscription bypass exploits.

Vybe reserves the right to employ automated content moderation (such as Google Cloud Vision SafeSearch) to flag and block prohibited imagery. We reserve the right to ban accounts violating these rules without notice or refund.

4. Subscriptions, Billing, and Cancellations

Vybe offers certain premium features (such as unlimited scans, unrestricted AI chat, and virtual try-on) under paid subscription tiers ("Main Character" and "Iconic").

• Billing: Subscriptions are billed on a recurring basis (monthly or annually) through your Apple App Store or Google Play Store account.
• Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Cancellations: You may cancel your subscription renewal at any time through the subscription management settings of your device's operating system. Uninstalling the app does NOT cancel your subscription.
• Refunds: Except when required by law, paid subscription fees are non-refundable. Vybe does not handle direct billing and cannot issue refunds; all refund requests must be directed to Apple or Google pursuant to their respective store policies.

5. Advertising (Free Tier)

If you use the "Fit Check" (Free) tier of the Service, you agree to the display of third-party advertisements integrated into the App via Google AdMob. You may encounter limits on daily scans or chat messages, which may occasionally be bypassed by voluntarily watching rewarded video advertisements.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Vybe and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Vybe.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply use the "Delete Account" feature within the App settings.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Vybe, its creators, directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

9. Disclaimer "AS IS"

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
